The book was transcribed from the original handwritten form - in many places the writing was very difficult to decipher so where there is uncertainty, alternative spellings or a ? are inserted.

Original spellings, where they are clear, have been transcribed unchanged, so some surnames and townland names vary from the way they are spelt in the 1857 Griffiths Valuation.

 

Certificate

I the Reverend Cornelius Henry Usher, Doctor in Divinity, in account of the United Parishes of Tully (alias Tullyferne /and Aghnish, commonly called Tullyaughnish, in the Diocese of Raphoe and County of Donegal, do hereby  certify that I have received from Thomas Brooke, Esq. of Lough Eask, in said county, the chief landlord or lessor seized in fee simple of the rent and reversion of all that and those lands and premises with their sub denominations of Killydonnel and Killycreen, also the towns and lands of Glenkeen, all situate lying and being within the limited parishes of Tully (alias Tullyferne and Aghnish, commonly called Tullyaughnish)  in the Diocese of Raphoe and County of Donegal, a notice in the words and figures following. Sir - Persuant to the provisions of the statute made and passed in the 2nd and 5th years of the reign of his present Majesty King William the 4th entitled "An act to amend three acts passed respectively in the 4th and 5th and in the 7th and 8th years of the reign of his majesty King George the 4th providing for the establishing of compositions for tithes in Ireland, and to make such compositions permanent; and one of the statutes made and passed in the 3rd and 4th years of the reign of his present majesty King William the 4th entitled "An Act for the Relief of the Owners of Tithes in Ireland." And for the amendment of the above recited Act of the 2nd and 3rd years of the reign of his present majesty, I hereby give notice that I am desirous to agree for and undertake as provided by the said acts upon your performing the matters and things prescribed and enacted by the said acts to be done and performed on your part,  the future payment of the tithe composition charged upon and issuable and payable out of the Townlands and premises herein after particularly described and mentioned, with their subdenominations situate and lying and being within the United Parishes of Tully and Aughnish, commonly called Tullyaughnish, in the County of Donegal, that is to say, the town and lands of Killydonnell and Killycreen bounded on the south by Carrycastle - West by Burnside - North by Ballyally - and East by Fortstewart; also the town and lands of Glenkeen bounded on the South by Lagnaceduff and Loughnakey, on the West by Forker, on the North by Aughamonson and on the East by Ballygay and Loughris; subject however to the deduction of £15 per centum, on the amount of such composition as provided by the said acts. And I hereby require you in pursuance of the said acts, to grant to me a certificate under your hand and seal, of the imposts directed by said acts, in order thay I may execute under my hand and seal, the Declaration required thereby; And, I also give you Notice that I am the chief landlord or lessor seized in fee simple of the rent and reversion of the said Townlands and premises; and I am ready to give you any further information in relation thereto, which you may require, on my receiving a notice from you to that effect.

Declaration

I, Thomas Brooke, Chief Landlord or Lessor seized in fee simple of the rent and reversion of all that and those the Townlands and premises with their subdenominations of Killydonnel and Killycreen and also the town and lands of Glenkeen, all situate and lying and being within the United Parishes of Tully (alias Tullyferne) and Aughnish, commonly called Tullyaughnish, in the Diocese of Raphoe and County of Donegal, declare my full and unqualified acceptance of the aforesaid Certificate and Declaration. And by these presents agree to, and accept the same in pursuance of the said Act of Parliament, passed in the 2nd and 3rd years of the reign of his present majesty King William the 4th, and also of one other statute made and passed in the 3rd and 4th years of the reign of his present majesty King William the 4th and referred to in my said notice.
